3. The Customer is responsible for providing correct and complete information, including their name, e-mail address, telephone number where required, billing information and delivery address.

4. In the case of a Custom-made Product, the Customer is responsible for providing accurate information and specifications necessary for the production of the Product.

5. The Seller shall not be responsible for errors resulting from incorrect information or specifications provided by the Customer, subject to the mandatory rights granted to the Customer under applicable law.

6. Before placing the final order, the Customer will be presented with information concerning the Product, price, delivery costs and other relevant order details.

7. A Sales Contract is concluded when the order has been properly submitted and accepted by the Seller in accordance with the ordering process.

8. Where advance payment is required, the Seller may begin processing an order after payment has been successfully received.

§4 HANDMADE PRODUCTS AND NATURAL MATERIALS

1. All Products offered by Woodcarved Tales are handmade or individually finished.

2. Wood is a natural material. Individual Products may therefore differ slightly in:

– wood grain,
– colour,
– texture,
– knots,
– natural marks,
– surface structure,
– minor carving details,
– paint application,
– finishing.

3. Such characteristics are a natural consequence of working with wood and handmade production.

4. Minor differences between individual Products do not constitute a defect or non-conformity where they do not affect the Product’s conformity with the contract or its intended purpose.

5. Product photographs are for illustrative purposes. The actual Product may differ slightly from photographs due to natural variations in wood, lighting conditions and differences between computer monitors, phones and other displays.

§5 CUSTOM-MADE PRODUCTS

1. Certain Products may be made according to the Customer’s individual specifications.

2. A Custom-made Product may include, for example:

– an individual design,
– a specific character,
– an individual size,
– an inscription,
– a specific colour scheme,
– a modification of an existing design,
– a sculpture based on Customer-provided information or references,
– other individual requirements.

3. Before production begins, the Seller may communicate with the Customer regarding the specifications of the Product.

4. The Customer is responsible for ensuring that the information and specifications provided to the Seller are accurate.

5. Once production of a Custom-made Product has started, changes requested by the Customer may not be possible or may require additional costs.

6. Where a Custom-made Product is made according to materials supplied by the Customer, the Customer confirms that they have the necessary rights to use those materials for the purpose of fulfilling the order.

§6 PRICES AND PAYMENTS

1. Prices displayed in the Store are stated in the currency indicated on the Store at the time of purchase.

2. Unless otherwise stated, prices applicable to customers in Poland include VAT where legally applicable.

3. Available payment methods are displayed during the checkout process.

4. The Seller may offer electronic payments, card payments, PayPal or other payment methods made available through the Store.

5. The Seller may begin processing an order after payment has been successfully received.

6. The price applicable to the Customer is the price displayed at the time the order is placed, subject to obvious pricing errors.

§7 INTERNATIONAL ORDERS, TAXES AND CUSTOMS

1. Woodcarved Tales accepts orders from customers located outside Poland, subject to the availability of delivery to the destination country.

2. Delivery costs are calculated or displayed during the ordering process where available.

3. For international orders, the Customer is responsible for providing a correct delivery address and any information required for customs clearance.

4. For shipments outside the European Union, the Customer may be required to pay import duties, customs charges, import VAT, brokerage fees or other charges imposed by the destination country.

5. Unless expressly stated otherwise during checkout, such charges are not included in the Product price or shipping cost and are the responsibility of the Customer where applicable.

6. Customs procedures and charges vary between countries. The Seller cannot guarantee the amount of any customs duty, tax or other charge imposed by the destination country.

7. The Customer is responsible for ensuring that the ordered Product may legally be imported into the destination country.

8. The Seller is not responsible for delays caused by customs authorities, import restrictions, customs inspections or other procedures outside the Seller’s control.

9. If a shipment is refused by the Customer or cannot be delivered because the Customer fails to complete required customs formalities, any refund or additional costs will be handled in accordance with applicable law and the circumstances of the particular case.

§8 DELIVERY

1. Products are shipped using courier companies, postal operators or other carriers selected by the Seller.

2. Available delivery methods and delivery costs are displayed during the ordering process.

3. The estimated processing time is indicated on the Product page or during checkout.

4. Ready-made Products are normally processed within the period indicated on the Store.

5. Custom-made Products may require additional production time. The expected production time will be communicated to the Customer where applicable.

6. Delivery times may vary depending on the destination country and the carrier.

7. The Seller makes reasonable efforts to dispatch orders within the stated processing time.

8. Products are appropriately packaged and protected against damage during transportation.

9. The Customer should inspect the external condition of the package upon delivery where reasonably possible.

10. If the package appears visibly damaged, the Customer is advised to photograph the packaging and, where possible, report the damage to the carrier.

§9 RIGHT OF WITHDRAWAL AND RETURNS

1. Consumers within the European Union generally have a statutory right to withdraw from a distance contract within 14 days without giving a reason, subject to statutory exceptions.

2. The withdrawal period normally begins when the Consumer, or a third party designated by the Consumer other than the carrier, receives the goods.

3. The right of withdrawal does not apply to certain goods made to the Consumer’s specifications or clearly personalised, where the applicable law provides for such an exception.

4. Accordingly, Custom-made Products created specifically according to the Customer’s individual requirements may not be eligible for withdrawal where the applicable law excludes such a right.

5. Examples may include a sculpture made specifically according to an individual design, person, character, inscription, dimensions or other personal specifications.

6. A Ready-made Product which is not subject to a statutory exception may be returned by an eligible Consumer in accordance with the applicable consumer protection laws.

7. Nothing in these Terms and Conditions limits mandatory statutory rights available to Consumers under the law applicable to their purchase.

§10 COMPLAINTS AND NON-CONFORMITY

1. If a Product is defective or does not conform to the Sales Contract, the Customer may have statutory rights under the law applicable to the transaction.

2. Customers in the European Union who qualify as Consumers or equivalent protected customers may exercise the rights provided by applicable consumer protection legislation.

3. Complaints should be submitted by e-mail to:

epsigon.art@gmail.com

4. Where possible, a complaint should include:

– order number,
– description of the problem,
– photographs showing the alleged defect or non-conformity,
– any other information reasonably necessary to assess the complaint.

5. The absence of any of the above information does not by itself prevent the Customer from submitting a complaint.

6. The Seller will respond to complaints within the period required by applicable law.

7. Depending on the circumstances and applicable law, a remedy may include repair, replacement, price reduction or termination of the contract.

8. The Seller may request that the Product or photographic evidence be provided for inspection where reasonably necessary to assess the complaint.

9. Nothing in this section limits any mandatory statutory rights of the Customer.

§11 INSPECTION OF THE PRODUCT BEFORE USE

1. Upon receiving the Product, the Customer should reasonably inspect it for visible damage and conformity with the order.

2. In the case of a sculpture or other handmade Product, the Customer should check in particular:

– whether the correct Product was received,
– whether there is visible transport damage,
– whether major elements correspond to the order,
– whether any visible parts have been damaged during shipping.

3. If visible damage or an obvious discrepancy is discovered, the Customer should contact the Seller before making modifications to the Product where reasonably possible.

4. This recommendation does not limit statutory rights relating to defects or non-conformities that could not reasonably have been discovered upon delivery.

§12 COLOURS, PAINT AND FINISH

1. Many Products are hand-painted or individually finished.

2. Because of the handmade nature of the Products, minor variations in paint application, colour and finish may occur.

3. Colours displayed on a computer, smartphone or other device may differ slightly from the actual Product.

4. Such differences may result from display settings, lighting conditions, photography and the characteristics of the materials used.

5. Where a specific colour or finish is agreed for a Custom-made Product, the Seller will make reasonable efforts to reproduce the agreed specification.

§13 NATURAL CHANGES IN WOOD

1. Wood may naturally react to changes in temperature and humidity.

2. Over time, natural wood may change colour, expand, contract or develop additional natural characteristics.

3. Products should be stored away from prolonged exposure to excessive moisture, water, extreme temperatures and intense direct sunlight unless the Product is specifically designed for such conditions.

4. Damage caused by improper storage, improper use, accidents, modifications or conditions outside the intended use of the Product is not the responsibility of the Seller, subject to mandatory applicable law.

§14 CUSTOMER-SUPPLIED MATERIALS AND INTELLECTUAL PROPERTY

1. If the Customer provides photographs, drawings, graphics, logos, inscriptions or other materials for the creation of a Custom-made Product, the Customer is responsible for ensuring that they have the necessary rights to use those materials.

2. The Customer must not provide materials that infringe the copyrights, trademarks, privacy rights or other rights of third parties.

3. The Seller may refuse to use materials where there are reasonable grounds to believe that their use could violate the rights of third parties or applicable law.

4. The Customer shall cooperate with the Seller in resolving any third-party claim concerning materials supplied by the Customer.

§15 PRODUCT USE AND CARE

1. Products should be used and stored in conditions appropriate for handmade wooden objects.

2. Unless otherwise stated in the Product description, Products are intended primarily for decorative purposes.

3. Products should be protected from prolonged exposure to:

– water,
– excessive humidity,
– extreme temperatures,
– direct sunlight,
– aggressive chemicals,
– other conditions that may damage wood, paint or finishing materials.

4. The Customer should follow any specific care instructions supplied with the Product.

§16 PRODUCT PHOTOGRAPHY AND DESCRIPTIONS

2. The actual Product may contain minor variations resulting from handmade production and the natural characteristics of wood.

3. Product descriptions are intended to provide accurate information concerning the Product’s main characteristics.

4. Where a Product is handmade, dimensions may vary slightly within reasonable manufacturing tolerances, unless exact dimensions have been expressly agreed.

2. The Customer may not copy, reproduce, distribute, commercially exploit or otherwise use such materials without the prior permission of the rights holder, except where permitted by mandatory law.

3. Purchasing a Product does not transfer copyright or other intellectual property rights in the Seller’s photographs, designs, sculptures or other creative works to the Customer unless expressly agreed otherwise.

§19 EVENTS BEYOND THE SELLER’S CONTROL

1. The Seller shall not be responsible for delays or failure to perform an obligation caused by circumstances beyond the Seller’s reasonable control, including natural disasters, war, armed conflict, strikes, transport disruptions, customs delays, government restrictions, serious technical failures or other extraordinary events.

2. This provision does not exclude or limit mandatory rights of Consumers under applicable law.

§20 INTERNATIONAL CONSUMER PROTECTION

1. These Terms and Conditions are primarily based on the laws applicable to the Seller in Poland.

2. For Consumers residing in the European Union or other jurisdictions where mandatory consumer protection laws apply, nothing in these Terms and Conditions is intended to deprive the Consumer of mandatory rights granted by the law of their country.

3. Where the law of the Customer’s country grants mandatory rights that cannot legally be waived by contract, those rights shall apply regardless of any conflicting provision of these Terms and Conditions.

4. For Customers outside Poland, additional consumer, tax, customs or import rules may apply depending on the destination country.

§21 OUT-OF-COURT DISPUTE RESOLUTION

1. Consumers may have the right to use out-of-court dispute resolution mechanisms available under the law applicable to their purchase.

2. Matters not regulated by these Terms and Conditions shall be governed by applicable law.

4. The Seller reserves the right to amend these Terms and Conditions where permitted by applicable law.

5. Amendments shall not affect orders placed before the amended Terms and Conditions entered into force, unless mandatory law provides otherwise.
